TERMS AND CONDITIONS OF SALE

Galerielecontainer.com (hereinafter referred to as "the site") is published by Container Galerie, a limited liability company with a capital of 5,000 euros, whose registered office is at 14, rue des Lauriers Roses, 13010 Marseille, France, registered with the Marseille Trade and Companies Register under no. 823388996, intra-community VAT no. FR 17388996 (hereinafter referred to as "Container Galerie"). All orders placed on the site are subject to these terms and conditions of sale. Container Galerie reserves the right to adapt or modify these general terms and conditions of sale at any time, the version of the general terms and conditions of sale applicable to any transaction being that appearing online on the www.galerielecontainer.com site at the time the order is placed.

I. THE CUSTOMER

The Customer declares that he/she is a natural person of at least 18 years of age and that he/she has the legal capacity or parental authorization to place an order on the site. When registering personal data on the site, the Customer must ensure the accuracy and completeness of the mandatory data provided. In the event of an error in the recipient's details, Container Galerie cannot be held responsible for the impossibility of delivering the product.

II. THE ARTICLES

The items offered for sale are those described on the site. Container Galerie takes the utmost care in the presentation and description of its articles to provide the customer with the best possible information. However, it is possible that non-substantial errors may appear on the site, which the customer acknowledges and accepts. 

III. ORDERING

Orders placed on the site are subject to compliance with the procedure put in place by Container Galerie, which consists of a succession of different stages that the customer must follow in order to validate the order. Before definitively confirming their order, customers will have the opportunity to check the details of their order and its total price, and to correct any errors before confirming it to express their acceptance. Any order confirmed by the customer constitutes a contract of sale and acceptance of all the stipulations of these general conditions of sale. Container Galerie will refuse any order from a customer with whom there is a dispute or incident relating to the payment of a previous order or who contravenes the provisions of these general conditions of sale. In this case, Container Galerie will inform the customer by e-mail. Should the customer fail to contact Container Galerie to correct any erroneous elements or elements that contravene these general conditions of sale, Container Galerie reserves the right not to process the order. A confirmation email summarizing the order (products, price, product availability, quantity, etc.) will be sent to the customer by Container Galerie. To this end, the customer formally accepts the use of electronic mail for confirmation by Container Galerie of the contents of his/her order. In all cases, invoices are issued at the time of delivery. 

IV. PRICES AND TERMS OF PAYMENT 

A. PRICE DETERMINATION 

Item prices are quoted in euros, inclusive of all taxes but exclusive of delivery charges. The total price of the order (including all taxes and shipping costs) is indicated in the shopping basket. Container Galerie reserves the right to modify its prices at any time, but products will be invoiced on the basis of the prices in force at the time the order is registered, subject to availability. IMPORTANT: For all orders shipped outside the EU, the customer will be responsible for any import duties or taxes charged by customs and for any carrier-related charges. Any additional charges will be collected from the customer by the carrier chosen at the time of delivery. 

B. METHOD OF PAYMENT

Products are payable in cash on the day the order is placed. Payment for purchases is made by bank card: the customer accesses a dedicated area provided by a banking establishment, which ensures the security and recording of the payment order. In this respect, the Customer expressly acknowledges that the communication of his/her bank card number to Container Galerie constitutes authorization to debit his/her account, in this case, for the products ordered. The data recorded and kept by Container Galerie constitutes proof of the order and of all transactions. The data recorded by the payment system constitutes proof of the financial transactions. 

V. DELIVERY 

Delivery is made to the delivery address indicated by the customer, it being specified that this must be the customer's home address or that of any other natural person of his/her choice domiciled in mainland France. Delivery cannot be made to hotels or post office boxes. Delivery to countries outside the European Union may be delayed due to customs duties which have not been accepted and paid by the customer. To ensure that delivery times can be met, you must check that you have provided complete and accurate information about the delivery address (such as road number, building number, staircase number, access codes, names and/or intercom numbers, etc.). Inaccurate information may result in longer delivery or forwarding times. The times indicated are indicative times, corresponding to average processing and delivery times. Container Galerie cannot be held responsible for the consequences of a delay in delivery for which it is not responsible. In the event of damaged packages (already opened, missing products, etc.), the Customer undertakes to notify the carrier by all available means of any reservations upon receipt of the package. The Customer also undertakes to notify Container Galerie of any reservations by e-mail or telephone within 3 days. 

VI. FEEDBACK AND EXCHANGES 

Customers who are natural persons have a cooling-off period of fourteen days from delivery of their order to return (at their own expense) the work to Container Galerie for exchange or reimbursement without penalty. After the fourteen-day period, the works delivered will be deemed to have been accepted by the customer. The right of withdrawal does not apply to legal entities. Items must be returned in their original packaging and condition, accompanied by a copy of the purchase invoice. Prior to any return, the customer must contact Container Galerie by email or telephone. Container Galerie will provide all necessary instructions, including the return address. In the event of a refund, this will be made within 14 working days of receipt of the returned item. Container Galerie reserves the right to refuse an exchange, credit note or refund if the work is damaged after return and receipt. For refund requests: The customer will be reimbursed in full for the amount of the purchase and the outward postage costs in accordance with the Chatel law. Return postage costs remain the responsibility of the purchaser. 

VII. APPLICABLE LAW 

All orders automatically imply the customer's acceptance of the general terms and conditions of sale. These general conditions of sale are governed by French law. In the event of a dispute arising from the present contractual relationship, the customer and Container Galerie undertake to seek an amicable solution before taking any legal action. In the event of a dispute, the competent courts of Nice shall have jurisdiction, notwithstanding multiple defendants or the introduction of third parties. 

VIII. RESPONSIBILITIES 

The company Container Galerie, in the online sales process, is only bound by an obligation of means; it cannot be held liable for any damage resulting from the use of the Internet network, such as loss of data, intrusion, virus, breakdown in service, or other involuntary problems. 

IX. INFORMATION AND FREEDOM 

The information collected by Container Galerie when a customer places an order is required to manage the transaction and, to this end, may be communicated in whole or in part to Container Galerie's service providers involved in the execution of the order. The customer is informed that the same personal data may also be collected by an organization responsible for analyzing orders and combating credit card fraud. In accordance with the French Data Protection Act no. 78-17 of January 6, 1978, the customer has the right to access, rectify, oppose and delete data concerning him or her. Furthermore, Container Galerie undertakes not to communicate, either free of charge or in exchange for payment, customer details to any third party not involved in the execution of the order.
